Agreement to Terms

By using or engaging in services provided by Disability Path Supports, you agree to the terms outlined below. These terms apply to all participants, their families, carers, and representatives who interact with or receive support from our organisation.

Service Delivery

Disability Path Supports provides NDIS-funded supports designed to meet the individual needs and goals of each participant. Our services are delivered in alignment with the NDIS Practice Standards and are tailored through personalised service agreements. We are committed to delivering our services with professionalism, respect, and care.

Eligibility and Client Responsibilities

Our services are available to eligible NDIS participants and individuals entering into private arrangements.  NDIS participants are responsible for providing accurate and up-to-date information regarding their NDIS plans and support needs. NDIS participants are expected to treat staff respectfully, maintain a safe environment during service delivery, and promptly inform us of any changes to their plans or needs.

Cancellations and Missed Appointments

We understand that plans can change. If you are unable to attend a scheduled service, we kindly request notice of at least 24 to 48 hours in advance, as outlined in your individual service agreement. If adequate notice is not given, a cancellation fee may apply in accordance with the NDIS Pricing Arrangements. Repeated short-notice cancellations or non-attendance may result in a service review.

Fees and Payments

Our fees are based on the current NDIS Pricing Arrangements and may change in line with NDIS updates. We claim payments through the NDIS portal, your nominated plan manager, or directly invoice self-managed clients. It is the participant’s responsibility to ensure there are sufficient funds available to cover the services agreed upon.

Privacy and Confidentiality

We are committed to safeguarding your personal and sensitive information. All information collected is handled in accordance with the Privacy Act 1988 (Cth), the Australian Privacy Principles, and the NDIS Code of Conduct. Our Privacy Policy outlines how we collect, use, store, and protect your information.

Feedback and Complaints

We value open communication and encourage feedback to help us improve. If you have a concern or complaint, we welcome the opportunity to address it promptly and respectfully. Should you feel dissatisfied with our response, you may escalate the matter to the NDIS Quality and Safeguards Commission via www.ndiscommission.gov.au or by calling 1800 035 544.

Limitation of Liability

Disability Path Supports is not liable for any loss, injury, or damage resulting from the use of our services, except where required by Australian consumer law or NDIS legislation.

Changes to Terms

We may update these Terms and Conditions as required. Any changes will be communicated in writing or made available on our website. Continued use of our services after changes indicates your acceptance of the updated terms.

Governing Law

These terms are governed by the laws of Western Australia and applicable Commonwealth legislation, including the National Disability Insurance Scheme Act 2013.
